MCA hosted Homeowners (HOA) and Condominium (CA) Association leaders at a Leader Forum held on November 13, 2019. The Forum focused on legislated responsibilities of HOA and CA Board of Directors, resources provided by the Fairfax County Office of Consumer Affairs and Virginia State Common Interest Property registration and complaint procedure requirements. Guest speaker Heather Gillespie, Virginia Common Interest Ombudsman, relayed that all HOA/CAs must register and submit a Complaint Procedure with the Common Interest Community Board. The Complaint Procedure must spell out the process that will be followed by the HOA/CA Board of Directors when a property owner submits a complaint to the HOA/CA Board of Directors.
Ms. Thompson, Fairfax County Consumer Affairs Branch, talked about the Homeowner and Condominium webpage maintained by her office. The webpage lists publications and resources Fairfax County offers to community leaders. She encouraged boards to sign up to have their contact information included in the voluntary listing of Homeowners, Condominium and Civic Associations. State and Fairfax County officials use this listing to contact communities when an issue might impact their neighborhood.
Ms. Kimberley O’Halloran-Perez, Attorney, Rees Broome, PC, concentrated on 2019 Virginia Legislative updates impacting HOAs and CAs. Most of the legislative changes related to required disclosure of the adequacy of reserves and the cost of maintaining stormwater runoff facilities, and rules related to home daycare centers. She also discussed the recent Virginia Supreme Court ruling related to holiday decorations. Sainani v. Belmont Glen HOA.
