FCC to Streamline Approval for 5G Small Cells

While acknowledging the validity of local zoning rules, the federal regulation would put short time limits on local review, limit unreasonable application of aesthetic considerations and prohibit application of utility under-grounding ordinances in a way that would prohibit wireless operators from deploying necessary equipment.

Years ago, Congress passed laws that balance local zoning regulations with the need for facilities for wireless services.  While Fairfax County has generally acted reasonably in balancing the two sets of rules, many localities around the nation have effectively stopped deployment. The FCC, using clear federal law, intends to stop such actions.

I expect the County to add language to its zoning ordinance to comply with the new FCC rules.
